Terms of Service

These terms are an agreement between you and Kuzu Media LLC (“OnArk,” “we,” “us”), the company that makes OnArk. They cover onark.app, the OnArk app, and the class pages we host for churches (together, the “Service”). By creating an account or using the Service, you agree to them. If you sign up for a church or other organization, you confirm you are allowed to accept these terms for it, and “you” includes that organization.
Effective dates: these terms apply to new accounts from September 18, 2026, and to existing accounts from October 18, 2026. Until then, existing accounts stay on the terms they signed up under.
1. Accounts
- You must be at least 18 to create an account.
- Give us accurate information and keep it current.
- Keep your login secure. You are responsible for what happens under your account, including by people you invite.
2. Free trial
New churches get a 21-day free trial. We ask for a card to start it, but charge nothing during the trial. We email you a reminder before the trial ends. If you do not cancel before the trial ends, your card is charged the annual price of the plan you chose, and your subscription begins. You can cancel during the trial from your billing page and you will not be charged.
3. Plans, billing, and automatic renewal
- Annual plans. Plans are billed once a year, in advance, at the price shown when you sign up or change plans. See pricing.
- Automatic renewal. Your subscription renews every year for another year, and we charge the card on file at the then-current price, until you cancel. We will tell you before a price change applies to your renewal.
- Check-in overages.Each plan includes a number of guest check-ins per billing period. Check-ins beyond that are billed at your plan's per-check-in rate at the end of the billing period. Your classes keep running when you go over.
- Changing plans. Upgrades take effect right away and are charged a prorated amount for the rest of the current period. Downgrades take effect at the end of the current period.
- Taxes. Prices do not include taxes, which you pay where they apply.
- Failed payments. If a payment fails, we will try again and let you know. If it keeps failing, we may pause your account until it is resolved.
- Payments are processed by Stripe under its own terms.
4. Cancelling
You can cancel any time from your billing page in the OnArk admin, or by contacting us. Cancelling stops the next renewal. You keep access until the end of the period you paid for. After that, your classes go offline to guests and building pauses, but we keep your work so you can pick up where you left off. If you want your data deleted instead, ask us.
5. Refunds
Ask within 3 days of any charge and we will refund that charge in full. After 3 days, charges are not refundable, except where the law requires. Details are in our Refund Policy.
6. Your data and your guests' data
- You own your content: your classes, videos, branding, and the information your guests give you. You give us permission to host, copy, process, and display it only as needed to run the Service for you.
- You are responsible for your guests' data. You decide what to collect from guests and what to do with it. You agree to collect it lawfully, tell your guests how you use it, get any consent the law requires (including parental consent for children), and not collect more than you need. Class answers can reveal religious beliefs; handle them with care.
- How we handle it. We process guest data only on your behalf and under your instructions, as described in our Privacy Policy. We do not sell it or use it to advertise to your guests.
- Connected tools.When you connect Planning Center or another service, you direct us to send data to it and receive data from it. That service's own terms apply to it.
- Automations. Automations you set up run when their conditions are met, including during check-ins made by admins. Review what your automations do before turning them on.
7. Acceptable use
You agree not to use the Service to:
- break the law or violate anyone's rights, including privacy and intellectual property rights;
- upload content you do not have the right to use, such as videos, music, or curricula you have not licensed;
- send spam or messages people have not agreed to receive;
- upload malware, probe or break our security, or overload the Service;
- scrape the Service, or resell it without our written permission.
8. Our property
The Service, including its software, design, and our own content, is owned by Kuzu Media LLC. We give you a limited, non-transferable right to use it while your account is in good standing. If you send us ideas or feedback, we may use them without owing you anything.
9. Suspension and termination
We may suspend or close an account that breaks these terms, puts others at risk, or has unpaid charges. Where we reasonably can, we will warn you first and give you a chance to fix the problem and to export your data. You may stop using the Service at any time.
10. Third-party links and embeds
The Service can link to or embed other services, such as YouTube and Vimeo videos. We are not responsible for their content or practices.
11. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise the Service will be uninterrupted, error-free, or meet every need, or that it will produce any particular result for your church.
12. Limitation of liability
To the fullest extent the law allows, neither we nor our suppliers will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim about the Service is limited to the amount you paid us in the 12 months before the claim, or $100 if you have not paid us. Some places do not allow these limits, so they may not all apply to you.
13. Indemnity
If someone brings a claim against us because of your content, the data you collect from your guests, or your breach of these terms, you agree to cover our reasonable losses and costs from that claim.
14. Governing law and disputes
Florida law governs these terms, without regard to its conflict-of-law rules. Before filing a claim, you agree to contact us and try to resolve it informally for 30 days. If you are a consumer in a country whose law gives you rights these terms cannot remove, those rights still apply.
15. Changes to these terms
If we make a material change, we will email account holders at least 30 days before it takes effect and update the date at the top of this page. If you keep using the Service after the change takes effect, the new terms apply. If you do not agree, you can cancel.
16. Other terms
These terms and the policies they link to are the whole agreement between us about the Service. If a part is found unenforceable, the rest still applies. Our not enforcing a term is not a waiver. You may not transfer these terms without our consent; we may transfer them as part of a merger or sale of our business. You confirm you are not located in a country under a U.S. government embargo and are not on a U.S. government list of restricted parties.
